By registering at www.freshsingle.com (hereinafter referred to as "operator"), you agree to the terms and conditions listed here. If you do not agree to the terms and conditions, you will not have to register. People who have not reached the age of 18 are also not allowed to use this service.

Legal validity

The following terms and conditions regulate the conditions under which www.freshsingle.com is used. Deviating regulations and in particular conditions of the customer (hereinafter referred to as "user") that contradict these terms and conditions are only valid if the operator agrees to them in writing.

Scope of services

The operator operates a contact platform on the Internet and offers the user the opportunity to create his own profile. Every registered user has access to the operator's databases, in which data about other co-users are stored and through which the user can establish contact with other co-users in order to build up relationships and friendships. The user can have the information of other co-users displayed in the databases, actively contact other co-users and be passively contacted by other co-users.

Conclusion of contract

The contract between the operator and the user for the use of the databases comes into being when the user registers. By registering in the operator's database, the user immediately becomes a member and declares his consent to the operator's terms and conditions. The user declares to the operator that they are at least 18 years of age.

Prices and costs

The operator's services are free of charge. The user does not incur any costs by using the services provided by the operator.

Term and termination of the contract

(1) The contract period begins with the registration of the user. The contract can be terminated at any time without notice by the operator or the user by deleting the account.

(2) If false information is intentionally or fraudulently provided when logging in or in the user's profile, this can result in civil action. Intentional false information will lead to an immediate termination of the contract. After termination of the contract, all user data will be irretrievably deleted by the operator.

User Duties and Responsibilities

(1) The user is solely responsible for the content of his profile and thus for the information he provides about himself. The user assures that the given data correspond to the truth and describe him personally. The user also assures that he has no business intentions.

The user undertakes to hold the operator harmless from any kind of lawsuits, damage, losses or claims that may arise through his registration and / or participation in this service, provided that these damages are not based on intent or negligence on the part of the operator or his vicarious agents . In particular, the user undertakes to indemnify the operator from any liability and from all obligations, expenses and claims arising from damage due to defamation, insult, violation of personal rights, due to the failure of services for users, due to the violation of intellectual property or other rights surrendered to release.

Furthermore, every user undertakes not to misuse the service, in particular:

• not to disseminate any defamatory, offensive or otherwise unlawful material or information about him
• not to use it to threaten or harass other people or to violate the rights (including personal rights) of third parties
• not to upload any data that contains a virus (infected software) or contains software or other material that is protected by copyright
• not to use it in a way that adversely affects the availability of the offers for other users
• not to intercept emails or try to intercept them
• Sending emails to users for no other purpose than communication, including promoting or offering goods or services to other users (except in cases in which this is expressly permitted by the operator)
• not to send chain letters
• No references to offers from third parties (e.g. links) that have the same or similar content should be entered in the user profile or sent via the internal mail system
• not to send any messages for commercial purposes
• no unsolicited messages with commercial or competing content (spamming) are sent to entice members.
• no customer solicitation for the purpose of making a profit, in particular by referring to your own value-added SMS or value-added numbers.
• no contact is made for the purpose of subsequent profit, in particular through subsequent reference to your own value-added SMS or value-added number advertising.
• not to mention names, addresses, telephone or fax numbers, e-mail addresses in the user profile

Failure to comply with one of the above-mentioned behavioral obligations can lead to immediate termination of membership as well as civil and criminal consequences for the user himself. In particular, the operator reserves the right to exclude the user from his service if, in the opinion of the operator, immoral, obscene or politically radical content or photos are distributed when registering or using the service.
