Terms of Service

These Terms of Service form an integral part of all services provided by the Operator to Users of the website www.freshsingle.com. By using the Portal, the User acknowledges and agrees to these Terms of Service.

Definitions and Parties

Portal: The website available at www.freshsingle.com
Operator: dConcepts, Alexander Drechsel, Grabenstr. 31, 71334 Waiblingen, Germany
User: Any person who uses the Portal
Account: The personal user account created by registration on the Portal

Scope of Services

The Operator provides users with the opportunity to create a publicly accessible personal advertisement for the purpose of meeting new people or finding a partner. Registration is required to access the Portal’s services. Registered users can view other profiles, contact other users, and be contacted by them. A discussion forum is also provided for users to ask questions, post answers, and exchange comments in the usual manner of an online forum.

Registration and Agreement

1. The contract between the Operator and the User for the use of the Portal is concluded upon registration by the User. The User must be of full legal age and must agree to these Terms of Service and the Privacy Policy.

2. Registration is completed by submitting the registration form with truthful and complete information, which must be kept up to date by the User.

3. Each User receives a personal Account protected by a password chosen by the User. The User must keep login details confidential and immediately report any misuse to the Operator.

4. The Portal can only be used after successful confirmation of the User’s email address. The Operator reserves the right to request identity verification or additional security checks to prevent misuse.

Prices and Fees

1. The use of the Portal is completely free of charge. There are no hidden or recurring fees.

2. Advertising is displayed on the Portal to finance its operation.

3. Users may optionally subscribe to a paid “Ad-Free Plan” to disable advertising. The exact price, duration, and payment details are clearly shown before any purchase is made.

Copyright and Intellectual Property

1. The User confirms that they own all necessary rights to any content uploaded or published on the Portal.

2. By submitting content, the User grants the Operator a non-exclusive, worldwide, and unlimited right to store, display, reproduce, and make the content publicly available within the Portal’s services, but not for commercial use outside the platform. This includes:

  • the right to store the content in the Portal’s database,
  • the right to make the content publicly accessible, in whole or in part,
  • the right to reproduce content when viewed by other users,
  • the right to place advertising around or near the content (e.g., banners, videos, pre-rolls).

3. If a User believes their content has been used unlawfully, they must notify the Operator immediately. Upon verification, such content will be removed.

4. The Operator may delete or block any content violating applicable law or third-party rights without prior notice. The User has no right to restoration of deleted content.

Termination and Deletion of Accounts

1. The contract begins upon registration and remains valid indefinitely. Both the User and the Operator may terminate it at any time without notice by deleting the Account.

2. Providing false or misleading information may result in immediate termination and potential legal action.

3. Forum posts remain visible even after account deletion to preserve the logical structure of discussions. Personal identifying data (such as username or contact details) will be anonymized upon deletion.

Liability and Indemnification

1. Each user is solely responsible for the content of their profile and the information they provide. The user warrants that the submitted information is accurate and personally relates to them, and that they do not pursue any commercial purposes on the platform.

2. The operator does not verify user-generated content for accuracy, completeness, or potential legal infringements. Users are solely responsible for the legality of the content they upload or publish. The user shall indemnify and hold the operator harmless from all claims, demands, damages, or costs (including reasonable legal fees) asserted by third parties due to violations of their rights or of applicable laws resulting from user-submitted content.

3. Upon becoming aware of any unlawful content, the operator will act without delay to remove or disable access to the affected material. Notifications of potential legal or copyright infringements can be sent to the contact address listed in the site’s legal notice (imprint).

4. As a service provider under § 10 TMG (German Telemedia Act), the operator is not obligated to monitor transmitted or stored third-party information, nor to investigate circumstances indicating unlawful activity. Liability arises only once the operator becomes aware of a specific violation.

5. Notice on Copyright Complaints:
This website operates under German and EU law. If you believe that any content on this platform infringes your copyright or other rights, please contact us directly before taking any legal action. We will promptly review your notice and, if necessary, remove or block the reported content in accordance with applicable German and EU regulations.

User Obligations

Users agree not to misuse the Portal, including but not limited to:

  • posting defamatory, offensive, or illegal material;
  • threatening, harassing, or violating the rights (including privacy rights) of others;
  • uploading data containing viruses or protected materials without authorization;
  • interfering with the Portal’s operation or availability;
  • sending messages for commercial, promotional, or spam purposes;
  • publishing external links or advertisements for similar services;
  • uploading content without owning or having permission to use it.

Violations of these rules may lead to immediate account termination and possible legal consequences. The Operator reserves the right to remove users or content deemed inappropriate, offensive, or extremist.

No Warning Without Prior Contact

In the event of competition law, copyright, or similar legal concerns, users or rights holders are requested to contact us directly before initiating legal proceedings. Any legal costs incurred from a warning notice sent without prior contact will be rejected as unfounded, in line with the duty to mitigate damages (§ 254 BGB).

Governing Law and Jurisdiction

1. The Operator may amend these Terms of Service with two weeks’ notice. Users will be informed via email and through publication on the Portal.

2. These Terms and any disputes arising from them are governed by the laws of the Federal Republic of Germany. Where legally permissible, the exclusive place of jurisdiction is the Operator’s registered business location in Germany.

3. If any provision of these Terms is or becomes invalid, the validity of the remaining provisions shall not be affected. In such a case, statutory law shall apply.
